Terms and conditions for the Free Translating Service
General
- The Free Translating Service (“the Service”) is provided by the Commonwealth of Australia, as represented by the Department of Home Affairs ABN 33 380 054 835 of 5 Chan Street, Belconnen ACT 2617 (“the Department”). When we use the terms “us”, “we” or “our” we are referring to the Department.
- We may from time to time engage a translation service provider/s to develop and maintain the Website and perform some or all of the Service.
- Your use of the Service is subject to the terms and conditions, collectively referred to as the Terms (“Terms”) set out below. These Terms comprise the Agreement between you and us. If you do not accept these Terms, you must refrain from using the Website or the Service.
- The terms and conditions available at General Terms and Conditions of Use, including the Website Terms and Conditions, also apply to your use of the Service.
Definitions and interpretation
- In these Terms:
- facilities to lodge an application to use the Service, either through the Free Translating Service portal using a registered account, or otherwise by submitting an application form provided by email or by post;
- a helpdesk which can be accessed via telephone, Website form and email;
- assessment of information and documents to confirm a User is eligible to access the Service in accordance with the criteria available here;
- assessment of information and documents to confirm a particular document meets the relevant criteria for translation in accordance with the criteria available here.
- communication with a User in the event the User is found ineligible to access the Service, or where a particular document does not meet the criteria for translation, and any request from a User to access the Service in exceptional circumstances;
- the translation of documents and the return of translated documents to the User, including any corrections or replacements that may be issued;
- response to complaints and feedback; and
- any other services provided by the Department from time to time.
In these Terms, the following rules of interpretation apply:
User Agreement
- By:
you acknowledge that you have read and accept the Terms and agree to be bound by them, and an agreement is formed between the Department and you (“Agreement”).
- We reserve the right to amend these Terms upon providing at least 14 days’ written notice of any amendments by publishing an alert on the Website. For some amendments we may also provide a notification via email to the registered email address of Free Translating Service account holders. Amendments may be based on the following:
with any such amendments coming into effect 14 days after the date of the notice, or from any other later date specified in the notice.
- Your continued use of the Service following any such amendment of these Terms will represent Your acknowledgment that You have read the Terms as amended and agree to be bound by the amended Terms. We recommend you review the Terms for amendments each time You use the Service.
- The Department may, at its discretion, refuse to grant you access to the Service, or suspend or cancel your existing access.
Legal Capacity
- You must be eighteen (18) years of age or over to create an account or use the Service.
- Any Application made by You to use the Service (“Application”) is an acknowledgement by You that You:
- The Department reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an Application to be made, for any loss or damage we may suffer as a result of a transaction entered into by a minor.
Applications
- Applications need to be made in writing using the online form and submitted from a registered account in the Free Translating Service portal. Email and postal applications can also be accepted where a User is unable to use the online form. All Applications must contain:

Obligations of User
- You are solely responsible for the contents of material provided. This includes, but is not limited to, material provided for translation or material provided in support of an Application to access the Service.
- You assume all risks associated with use of the Website and the Service, including:

Document Authenticity
- You warrant that all material provided to the Department for the purpose of translation are true, accurate, complete, and unaltered copies of the original documents. You must not submit any document that is fraudulent, forged or otherwise inauthentic.
- You agree that the submission of any forged, altered, or otherwise fraudulent documents or false information for the purpose of obtaining a translation constitutes a breach of these Terms. You Acknowledge that under Division 137.1 of the Criminal Code Act 1995 (Cth) it is a serious offence to give false or misleading information to a Commonwealth entity.
- The Department may report any suspected fraudulent, forged, or materially altered documents to the relevant law enforcement or regulatory authorities. Where the Department reasonably suspects or becomes aware that documents submitted by you are false, altered or fraudulent, or that material information has been misrepresented:
Information that you provide to us
- When you submit information on the Website or as part of the Service, you grant the Department a licence to use, reproduce, adapt, modify, distribute and communicate that material in any way, now and in the future for the purposes of providing or managing the Services and for any related Commonwealth purpose.
- You warrant that you have all of the necessary rights, including copyright, in the content you contribute, that your content is not defamatory and that it does not infringe any law.
- You consent to the Department engaging in any conduct that may otherwise constitute a breach of your moral rights, in relation to any content that you provide to the Department, where such conduct is otherwise in accordance with these Terms.
- By agreeing to these Terms, you consent to the Department’s use of your personal information for the purposes of supplying the Service. Nature of Relationship
- Nothing in the Terms shall be construed to place the Department and you in a relationship of partner, principal and agent or as entering into a joint venture.

Indemnity
- You must at all times indemnify, and keep indemnified, the Department including its officers, employees, contractors and agents (“those indemnified”) from and against any liability, loss, costs or expense, incurred by those indemnified, arising from:
- For the purposes of clause 29, loss, costs and expenses includes costs incurred in dealing with any claim against those indemnified including legal costs and expenses on a solicitor/own client basis and the cost of time spent, resources used or disbursements paid by the Department.
- Your liability to indemnify the Department will be reduced proportionately to the extent that any breach of the Terms by the Department or any act or omission involving fault on the part of the Department or other person contributed to the liability, loss, cost or expense.
- The right to be indemnified is in addition to, and not exclusive of, any other right, power or remedy provided by law.
Privacy
- Your personal information is protected by law, including the Privacy Act 1988 (Cth), and is collected by us to provide you with the Service.
- Your information may be used by us or given to other parties to facilitate the provision of services to you, where you have agreed or it is required or authorised by law. Communications
- Users registered with the Service agree to receive emails from time to time in relation to their Application.
- We may, from time to time, provide information about changes to the Service via the Website. You must refer to the Website for any general information and communications that may impact on the delivery of the Service.
Security
- The Department will make all reasonable efforts to ensure Your information is secure, accurately recorded and not corrupted or changed.
- The Department is responsible for the security of your information while it is collected by, stored on or passing through its systems. Refer to the TIS National Security Policy available here: https://www.tisnational.gov.au/en/Policies/Security-Notice for further information.
- We are collecting your personal information for the purpose of processing your requests or responding to your enquiries. Information provided may also be used for training, education and quality assurance purposes. We will not be able to process your requests or respond to your enquiries without collecting relevant personal information about you.
Severability
- If any part of these Terms is found to be void, invalid, unlawful or unenforceable then that provision or part thereof will be deemed to be severed from these Terms and the remaining terms and provisions of these Terms will remain in force and constitute the Agreement between you and the Department.
Waiver
- The failure by the Department to exercise or enforce any right or provision under these Terms will not constitute a waiver of such right or provision. Any waiver of any rights or provisions under these Terms will only be effective if it is in writing and signed by us.
Termination
- Should you object to the Terms or any subsequent modifications to the Terms or become dissatisfied with the Service in any way, your only recourse is to immediately discontinue use of the Website and any part of the Service.
Governing Law
- These Terms will be governed by and interpreted in accordance with the laws of the ACT and you irrevocably submit to the non-exclusive jurisdiction of the courts of the ACT.
- If you access the Website or Services in a jurisdiction other than ACT, you are responsible for compliance with the laws of that jurisdiction, to the extent that they apply.
